Terms of Service

These Terms of Service (the Terms) govern your access to and use of florin.fi, its pages, features, data, charts, content, and related services (together, the Service). Please read them carefully.

Agreement and Eligibility

These Terms are an agreement between you and the owner and operator of Florin (Florin, we, us, or our). The Florin Parties are Florin and its owner, operator, affiliates, contractors, licensors, service providers, and each of their respective officers, directors, employees, and agents.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, do not access or use the Service. If you use the Service on behalf of a company or other organisation, you represent that you have authority to bind it, and you includes both you and that organisation.

You must be at least 18 years old and legally capable of entering into these Terms. You may not use the Service if doing so would violate applicable law, including sanctions, export-control, or trade-control laws. You are responsible for complying with the laws that apply to you and your use of the Service.

Nothing in these Terms excludes, restricts, or modifies a right or remedy that cannot lawfully be excluded, restricted, or modified. If you are a consumer, you retain all mandatory protections of the law applicable to you.

The Service

Florin observes selected activity on Arc and presents analytics that may include reference rates, trade and settlement data, token and pair information, pool and liquidity metrics, venue and network statistics, address activity, token balances, rankings, estimates, charts, methodology, and editorial content. The Methodology describes the current coverage and calculation methods in more detail and forms important context for interpreting the Service.

The Service is currently a free, public, account-free analytics interface. Unless Florin expressly agrees otherwise in writing, these Terms do not grant access to an API, data feed, service-level commitment, paid subscription, or right to receive support. Florin may introduce separately governed products or features in the future.

Florin does not operate, control, validate, or comprehensively monitor Arc, any blockchain node, bridge, oracle, smart contract, token, issuer, pool, protocol, venue, exchange, wallet, or other third-party system. Coverage is selective rather than comprehensive. A listing, classification, metric, link, logo, or reference does not mean that Florin has audited, verified, approved, endorsed, or recommended the subject.

No Advice or Transaction Services

All information is general and informational. Nothing in the Service is investment, financial, trading, legal, tax, accounting, compliance, valuation, or other professional advice; a recommendation or solicitation to buy, sell, hold, lend, borrow, stake, bridge, or otherwise use any asset or service; or an offer to enter into any transaction.

Florin is not acting as your broker, dealer, exchange, investment adviser, commodity trading adviser, fiduciary, custodian, lender, money transmitter, payment provider, execution venue, oracle provider, rating agency, or benchmark administrator. No fiduciary, advisory, agency, client, or professional relationship is created by your use of the Service or by any communication with Florin.

Rates, fixing values, prices, liquidity figures, spreads, costs, APRs, rankings, and other metrics displayed by Florin are analytics derived under Florin's published methodology. They are not executable quotes, bids, offers, net asset values, appraisals, guarantees of liquidity, or promises that a transaction can be completed at any displayed value. A Florin reference rate is not a regulated benchmark and must not be incorporated into a financial instrument, smart contract, settlement mechanism, liquidation process, or other legally binding arrangement without Florin's prior written agreement and your own independent validation.

You are solely responsible for your decisions, due diligence, risk assessment, and compliance obligations. Before acting on digital-asset information, verify it against primary sources and obtain advice from appropriately qualified professionals.

Data and Blockchain Risks

The Service concerns public blockchain environments whose tokens and balances may or may not have real-world value. Onchain activity may be generated by bots, protocol teams, automated strategies, or actors seeking to manipulate rankings or metrics. Contracts, chain state, token supplies, and transaction histories may be upgraded, reset, reorganised, replaced, paused, exploited, or removed without notice. Observed performance, liquidity, participation, and execution quality do not guarantee future conditions or adoption.

Florin relies on public blockchain records, nodes, contract events and state, protocol interfaces, configuration, and third-party infrastructure. Those sources can be incomplete, delayed, inconsistent, incorrectly decoded, unavailable, or changed without notice. Florin's indexing, classification, pricing, aggregation, estimation, and display processes can also contain errors or lag the chain tip. Historical results may change when source data, coverage, classifications, or methodology are corrected or updated.

In particular, you acknowledge that:

• Florin does not cover every transaction, protocol, venue, pool, token, bridge, route, or offchain activity;
• published activity may include wash trading, self-trading, Sybil activity, spam, manipulation, duplicated economic activity, or transactions without genuine economic intent;
• notional values, TVL, fee estimates, execution-cost measures, and reference rates depend on stated assumptions, eligibility rules, observation windows, and available pricing data;
• zero, unavailable, unpriced, estimated, derived, and observed values have different meanings explained in the Methodology;
• data timestamps and as-of blocks differ by metric, and live or third-party systems may have moved since the displayed observation;
• smart contracts and digital assets are experimental and may contain defects, exploits, admin controls, economic design failures, depegging risk, or total-loss risk; and
• displaying an onchain address or its activity does not identify its owner, establish beneficial ownership, attribute intent, or imply lawful or unlawful conduct.

You must independently verify any data before relying on it. Florin has no duty to update, correct, preserve, or continue publishing any item, although corrections may be reported to hello@florin.fi.

Intellectual Property and License

As between you and Florin, Florin or its licensors own the Service and all protectable rights in its software, code, original text, graphics, branding, design, selection and arrangement, taxonomies, databases, compilations, calculations, methodologies, derived metrics, and other content (Florin Content). These Terms do not claim ownership of underlying public blockchain records or third-party material beyond the rights Florin or its licensors lawfully hold. Third-party names, logos, and trademarks belong to their respective owners.

Subject to these Terms, Florin grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Service for your lawful personal or internal business research. No other right is granted, and all rights not expressly granted are reserved.

You may quote limited excerpts and reproduce individual, static screenshots of Florin Content in journalism, academic work, research reports, or commentary without separate permission if you:

• accurately and prominently attribute Florin and link to the relevant Florin page;
• do not materially alter or present the content in a misleading way;
• retain applicable copyright, source, methodology, and risk notices;
• do not imply Florin's endorsement, sponsorship, partnership, or verification; and
• do not create a substitute for the Service or redistribute a material, systematic, live, or machine-readable portion of Florin Content.

Any bulk, systematic, automated, commercial data redistribution, white-labelling, syndication, data-feed use, or use in a product or service requires Florin's prior written permission. Rights provided by applicable law, including applicable quotation, fair-use, fair-dealing, and database exceptions, are unaffected.

If you send Florin ideas, suggestions, corrections, or other feedback, you grant Florin a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, and incorporate that feedback for any purpose without compensation or attribution. Do not provide feedback you are not authorised to provide.

Acceptable Use

Except where applicable law expressly permits it despite these restrictions, or Florin gives prior written permission, you must not:

• scrape, crawl, spider, mine, harvest, record, or extract the Service or Florin Content by automated means, except for general-purpose search engines complying with Florin's published crawler instructions;
• bulk download, reproduce, republish, distribute, sell, license, sublicense, rent, mirror, frame, white-label, or make available the Service or a material part of Florin Content;
• use the Service or Florin Content to build, train, test, improve, benchmark, market, or support a competing database, analytics product, data feed, machine-learning model, or artificial-intelligence system;
• reverse engineer, decompile, disassemble, probe, or attempt to discover source code, non-public data, algorithms, credentials, vulnerabilities, or security mechanisms;
• bypass access controls, crawler instructions, rate limits, or other technical restrictions, or access the Service through an interface Florin has not intentionally made available;
• interfere with, overload, disrupt, damage, or compromise the Service or any connected system, including by introducing malware or making abusive requests;
• use Florin's name, marks, layout, or content to impersonate Florin, misstate the source or meaning of data, or suggest an affiliation, endorsement, or guarantee that does not exist;
• remove or obscure proprietary, source, risk, methodology, or attribution notices;
• use the Service to harass, threaten, defame, discriminate against, unlawfully surveil, or attempt to identify a person behind an onchain address; or
• use the Service for fraud, market manipulation, infringement, unlawful activity, or any purpose that violates another person's rights or applicable law.

You may link to public pages of the Service in a fair and lawful manner that does not damage Florin's reputation or imply an association that does not exist. Florin may withdraw linking permission where a link is deceptive, unlawful, or presented in an objectionable context.

Third-Party Services

The Service may display or link to Arc explorers, protocol sites, token issuers, venues, social networks, infrastructure providers, and other third-party websites, products, data, or services. Florin does not control and is not responsible for them. Links are provided for convenience and context, not as endorsements.

Your use of a third party is governed by its own terms, privacy notices, fees, and risks. You are responsible for reviewing them. Florin is not a party to, and has no responsibility for, any transaction or dispute between you and a third party. Never provide a private key, seed phrase, password, or signing approval in response to anything presented as Florin; the Service does not require them.

Florin is independent and is not affiliated with or sponsored by Circle, Arc, any token issuer, or any tracked protocol or venue unless Florin expressly states otherwise in writing. Third-party trademarks remain the property of their owners.

Privacy and Communications

Operating and securing the Service may involve processing technical information such as request data, IP address, device or browser information, and usage events through Florin's infrastructure and analytics providers. If you contact Florin, Florin receives the information you choose to provide and may use it to respond, operate and protect the Service, keep appropriate records, and comply with law. The handling of personal data remains subject to applicable data-protection law and any then-current privacy notice published by Florin.

Blockchain records are public and may be permanent. Florin's display of an address or transaction does not mean Florin knows or asserts the identity of a natural person associated with it. Do not send Florin sensitive personal information, confidential trading information, account credentials, private keys, or seed phrases.

You may send legal, privacy, security, or data-correction notices to hello@florin.fi. Email is not guaranteed to be secure, confidential, or received. Florin may retain and use communications as reasonably necessary for the purposes above.

Changes, Access, and Termination

Florin may add, remove, correct, reclassify, or change content, coverage, methodology, features, URLs, and availability when reasonably necessary to develop or secure the Service, comply with law, respond to third-party or infrastructure changes, correct errors, or prevent abuse. Florin may suspend, restrict, or discontinue all or part of the Service and may block access reasonably believed to violate these Terms, threaten the Service, expose Florin or others to risk, or be unlawful.

Florin does not promise that any content, feature, metric, or historical record will remain available. You are responsible for keeping any permitted copy you need. Florin will not be liable for a modification, suspension, restriction, or discontinuation except where liability cannot be excluded by law.

Florin may revise these Terms for legal, regulatory, security, operational, or Service-related reasons. Revised Terms will be posted here with an updated date and apply prospectively from their stated effective date. Where required by law, Florin will provide additional notice. Your continued use after revised Terms take effect constitutes acceptance; if you do not agree, you must stop using the Service.

Your right to use the Service ends automatically if you materially breach these Terms. Provisions that by their nature should survive will survive, including those concerning intellectual property, disclaimers, liability, indemnity, disputes, and general terms.

Disclaimers

To the fullest extent permitted by applicable law, the Service and all Florin Content are provided “as is” and “as available,” at your sole risk.

The Florin Parties disclaim all express, implied, and statutory warranties and conditions, including warranties of accuracy, completeness, timeliness, availability, security, reliability, merchantability, satisfactory quality, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. Florin does not warrant that the Service will be uninterrupted, error-free, secure, free of harmful components, compatible with your systems, or corrected; that any data source or methodology is suitable for your purpose; or that displayed data reflects current, complete, genuine, or economically meaningful activity.

No statement or communication creates a warranty unless Florin expressly agrees to it in a signed written agreement. You assume all risk arising from use of, inability to use, or reliance on the Service, including the risk of trading loss, investment loss, loss of digital assets, lost opportunity, erroneous reporting, compliance failures, and decisions made by you or third parties.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.

Limitation of Liability and Indemnity

To the fullest extent permitted by applicable law, the Florin Parties will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage, or for any loss of profits, revenue, business, opportunity, goodwill, reputation, data, digital assets, anticipated savings, or trading or investment value, arising out of or relating to the Service or these Terms, under any legal theory, even if advised that the loss was possible.

Without limiting the preceding paragraph, the Florin Parties will not be liable for loss arising from data errors, omissions, delay, manipulation, reclassification, or unavailability; your reliance on analytics or estimates; blockchain, node, bridge, oracle, smart-contract, token, protocol, venue, or third-party acts or failures; unauthorised access, malware, or service interruption; or a decision or transaction made by you or anyone else.

To the fullest extent permitted by law, the aggregate liability of the Florin Parties for all claims arising out of or relating to the Service or these Terms will not exceed the greater of EUR 100 and the amount you paid Florin for the Service during the 12 months before the event giving rise to the claim.

These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited, which may include liability for fraud, wilful misconduct, gross negligence where applicable law prohibits its limitation, or death or personal injury caused by negligence. They do not limit mandatory consumer rights. Each limitation is intended to be independent and will apply even if a remedy fails of its essential purpose.

Business-user indemnity

If you use the Service on behalf of a business or for professional purposes, then, to the fullest extent permitted by law, you will defend, indemnify, and hold harmless the Florin Parties from third-party claims, liabilities, damages, judgments, losses, and reasonable legal fees arising from your material breach of these Terms, unlawful use of the Service, infringement of another person's rights, or misuse or redistribution of Florin Content. Florin may control the defence and settlement of a covered claim, and you will reasonably cooperate. Florin will not settle a claim in a way that admits your fault or imposes a non-monetary obligation on you without your consent, not to be unreasonably withheld. This indemnity does not apply to consumers to the extent prohibited by applicable law.

Disputes and General Terms

Before starting a formal claim, you and Florin will each use reasonable efforts to resolve the dispute informally. A notice must describe the dispute and requested relief and be sent to hello@florin.fi. The recipient will have 30 days to respond. This requirement does not prevent urgent injunctive relief, a claim needed to avoid expiry of a limitation period, or use of a mandatory statutory complaint process.

Governing law and jurisdiction are determined by applicable law and conflict-of-laws rules unless you and Florin agree otherwise in writing. If you are a consumer, nothing in these Terms deprives you of mandatory protections or the right to bring proceedings in a court available to you under applicable consumer law.

These Terms and any expressly incorporated terms are the entire agreement between you and Florin concerning the Service and supersede prior discussions on that subject. They do not alter a separate written agreement signed by Florin. If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. Florin's failure to enforce a provision is not a waiver. Headings are for convenience only.

You may not assign or transfer these Terms without Florin's prior written consent. Florin may assign them as part of a merger, reorganisation, financing, sale of assets, or transfer of the Service, provided that any mandatory consumer rights are not reduced. There are no third-party beneficiaries except that each Florin Party may enforce provisions that expressly protect it.
